Daniel M. King Sr is registered with the Georgia Office of Dispute Resolution, www.godr.org, 404 463 3787, Supreme Court of Georgia, to conduct mediation in court-connected alternative dispute resolution programs.
Court-Related or Private Mediation:
Dan is available to assist you to reach an agreement without having to go through a court hearing or trial. Whether a complaint or claim has been filed in court or not, Dan can help you resolve the issues in dispute.
Where is the mediation done? Are attorneys present? Can mediation be done by phone or email?
Mediation is available in an office or conference room setting and by telephone or email. Attorneys are welcome to participate in mediation sessions but the mediator does not require that attorneys be present. It is advised that you have an attorney discuss with you the legal ramifications of any terms of an agreement.
What are costs for mediation?
Current charges are $60.00 per person per hour. There is a one-time administrative fee of $30.00 per person. In addition, travel and other expenses apply when Dan travels to your location. You may save travel expenses by attending mediation sessions in Dublin, GA..
The administrative fee and two hours professional fees are paid in advance to schedule the first session. These fees are minimum charges and are not reimbursable. Fees beyond the first two hours are paid at the end of each day's mediation sessions.
What happens after an agreement is reached?
When an agreement is reached, Dan puts it in writing for signatures of all persons participating in the mediation. He provides copies to the negotiators (parties) and files the agreement with the court if the complaint or claim has been filed in court. In the case of private mediation, the persons reaching agreement may wish to consider making the agreement a legally binding contract.
What kinds of problems or cases can be resolved through mediation?
In court-connected programs, Dan works with parties to resolve general civil cases such as personal injury and similar cases. Domestic cases involving divorce, custody, child support, parenting plans, asset/debt distribution, and modifications are part of his work also. He has worked with youth, parents, and school officials to resolve juvenile cases. In magistrate court, he works with tenant and landlord issues, delinquent account claims, employment disputes, criminal warrant applications, and other cases.
What about mediation when a matter has not been filed as a case in court?
Dan can offer private mediation when a case has not been filed with the court system. Private mediation can be provided for both complex matters of the type that might normally be filed in court and for simpler matters not usually filed in court.
Is there a charge for an inquiry about mediation services?
Prior to a contract for his professional services, Dan offers telephone time of up to fifteen minutes without charge. After a contract is signed, calls for scheduling are included in the administrative fee. Additional printed information explaining mediation is available by request.
How do I get started with mediation?
You or your attorney are welcome to call to schedule mediation. Dan will be glad to contact the other persons involved in the disagreement if that will be helpful and if you can provide contact information.
